At age 46, I feel strongly about the proposals to change Medicare. As someone who has been out of work (and therefore out of health insurance) for far too long, I feel strongly about the need for healthcare reform so that all Coloradans have ACCESS to basic healthcare needs.

Efforts are underway here in Colorado to establish a statewide healthcare cooperative.

Conservatives want to contain costs and have freedom of choice, while liberals want to cover everyone. The Cooperative would do both.

The Cooperative is based on legislation introduced by CO State Senator, Irene Aguilar, MD

The Cooperative is based on legislation introduced by CO State Senator, Irene Aguilar, MD - a well-respected doctor who got fed up with health care inequities and decided she needed to run for the seat vacated by Sen. Chris Romer when he resigned his Senate seat to run for mayor.

The Co-op would create a single risk pool where all residents of Colorado would be owner-members of the Co-op. We (the State of CO) would ask for waivers and pool all Medicare, Medicaid, VA benefits and other state-funded programs, such as the Colorado Indigent Care Program (CICP), which gives many who aren't eligible for Medicaid or other government-funded assistance programs, access to low-cost clinics based on sliding scale income.

Instead of paying premiums to a health insurance company, individuals and business would pay smaller premiums based on payroll and income - it will bring down health care costs for everyone, including business owners who would no longer have to worry about the time and expense of administering health insurance plans for their employees - and their health care costs would be predictable.

Of course, if individuals still want to purchase additional 'cadillac' plans from the insurance companies for benefits not covered by the Cooperative, they are free to do so.

It's a win-win for business owners, patients and providers!

Executives and directors at DaVita Inc. have found themselves the target of a new lawsuit after the company settled a whisteblower complaint out of Texas last month for $55 million.

After a 10-year battle in the courts, the Denver-based kidney dialysis provider finally settled allegations the company had improperly billed the federal government for hundreds of millions in wasted and unnecessary medicines.

That agreement, however, triggered another lawsuit in U.S. District Court for Colorado on Tuesday from Courtney Clark, a New York resident and DaVita shareholder.

Clark claims DaVita's executive team, including CEO Kent Thiry, violated their fiduciary duties to the company by not complying with federal regulations and the company's own rules.

Clark is suing the executives on the company's behalf, asking them to personally reimburse the company $55 million plus another $23 million in legal fees from the original case.

"Plaintiff brings this action to recover for the benefit of the company the damages caused by the individual defendants," the complaint said.

The legal argument, however, will have to overcome the long standing practice of companies indemnifying management in the course of their work. The initial settlement also did not trigger a drop in DaVita shares, a typical source of damages claimed in most shareholder lawsuits.

"Suits of this nature are an unfortunate but fairly typical opportunistic litigation in this environment," responded company spokesman Skip Thurman.

I can't imagine what I would have done if this happened to my kid - I don't like to think about it.  As a fellow father I did think of something though I could do, and I've done it.

I've emailed Jim Cramer, the stock guru.  Jim Cramer has a power we don't, to make wells fargo look really bad.  As a fellow father maybe he could be convinced to use his power?  My wish?  To see some people fired - and maybe in jail, all we can do is ask.
